Kisutu court adjourns Chadema followers' case


The Kisutu Resident Magistrate Court
 The Kisutu Resident Magistrate  Court yesterday adjourned the case facing eight people who are alleged to be Chadema followers charged with three counts including publication of inaccurate information because the investigation into a case was incomplete.
 
The prosecution led by Principal State Attorney, Edwin Kakolaki informed the court that the case came for mention and the investigation was still on ongoing.
 







Principal Resident Magistrate Respicius Mwijage adjourned the case to December 14 when it comes up for mention for the accused Kim Hyuwook (42), a South  Korean because was still in custody for lack to meet bail condition while the mention for other accused will be December 24, this year.
 
Apart from Hyuwook other accused are Mashinda Mtei (49), Julius Mwita (30), Politician,  Frederick Eddie Fussi (25), Information Technology, , Julius Mtei (45), a Kenyan, Meshack Mlawa (27),  Anisa Rulanyaga (41), Engineer, Jose Mavinga Nimi, (51), From Angola who lives in Paris.
 
In the first offence the accused are charged Contrary to section 16 of the Cybercrime Act, No.14 of 2015.
 
It was alleged that on diverse dates between 25 and 26, October, this year at different locations within the city and region of Dar es Salaam all the accused published through an online national Election Management system titled “M4C Election results Management System”.
 
They also publish the said results to other social media titled “face book  and Twitter” inaccurate unverified data to wit, Tanzania presidential election 2015 results with intent to mislead the public on the ongoing release of election results by the National Electoral Commission.
 
Kakolaki alleged that on the second count that is for the accused Mtei, Mavinga, and Hyuwook they are charged with the offence of engaging in employment without permit contrary to sections 16(2) and 31(1) (m) at the Immigration Act (Cap 54 R: 2002) as amended by Act No.8 of 2015.
 
It was alleged that on the same day at King D Hotel within Kinondoni District in the city the accused being a Kenyan, Angolan and Korean nationals with Passport No. A1532119, 930879 and M 27687807 respectively engaged in the employment of collecting and publishing election results for Tanzania presidential election 2015 for  CHADEMA  without valid permits.
 
On the last count that is for the accused Mtei it was alleged that  on the same date the accused being a Kenyan national with Passport No. A 1532119, engaged in business activities for and on behalf of WANAMA SACCOs without a valid permit.
